Great news for workers. California will lead the world with this new Bill. It's already passed the Assembly and Senate Appropriations Committee and now moves to a full Senate vote. It will use a 3-part test for companies that want to label a worker a contractor.
"A company will have to complete an 'ABC test' to classify a worker
as a contractor, proving they are (a) free from the company’s control,
(b) doing work that isn’t central to the company’s business, and (c)
have an independent business in that industry. If the worker doesn’t meet all three of these standards, they will be
classified as an employee and entitled to benefits including
unemployment insurance, health care subsidies, paid parental leave,
overtime pay, and a guaranteed $12 minimum hourly wage."
